Terms of Service
Welcome to Ride Cult / RideStats (the "Service", "App", "we", "us", or "our"). By creating an account, installing, or using the Service, you agree to these Terms of Service (the "Terms"). If you do not agree, do not use the Service.
1. Eligibility & Account
You must be at least 16 years old (or the minimum age required in your jurisdiction) to use the Service. You are responsible for keeping your login credentials confidential and for all activity under your account.
2. License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Service on devices you own or control, solely for personal, non-commercial purposes.
3. Acceptable Use
You agree not to:
- Use the Service in violation of any law or regulation;
- Reverse-engineer, decompile, or attempt to extract source code, except as expressly permitted by law;
- Interfere with or disrupt the Service, our servers, or other users;
- Use the Service while operating a vehicle in any manner that distracts you or violates applicable traffic laws — the App is intended for passive recording, not active interaction while driving.
4. Promotional and Early-Supporter Plans
RideStats may, at its sole discretion, offer promotional benefits including but not limited to free access for an initial group of users, extended trial periods, discounted subscriptions, or other early-supporter incentives. By accepting these Terms, you acknowledge and agree that:
- Eligibility and allocation of any promotional benefit are determined solely by RideStats, including the total number of users eligible, the order of allocation, and the duration of any free or discounted access.
- Promotional benefits are not contractual entitlements. They are gratuitous and revocable. RideStats reserves the right to modify, reduce, suspend, or terminate any promotional benefit at any time, with or without notice, including but not limited to changes in the duration of "lifetime" or "free-for-life" access.
- No refund or compensation shall be owed by RideStats for the modification, suspension, or termination of any promotional benefit, except where required by applicable law.
- Promotional benefits do not survive Service discontinuation. If RideStats ceases to operate the Service, in whole or in part, for any reason (including but not limited to business closure, regulatory requirement, force majeure, or commercial unviability), any promotional access shall terminate automatically without further obligation on RideStats's part.
5. Subscriptions & Billing
Paid subscriptions are processed through the Google Play billing system (or Apple's In-App Purchase, when iOS is supported). You authorize the relevant store to charge your payment method on the schedule of your selected plan. Subscriptions auto-renew unless cancelled in your store account before the renewal date. Refunds are subject to the policies of the relevant store and applicable law.
6. Modification and Discontinuation of Service
RideStats reserves the right, at its sole discretion and without liability, to modify, suspend, or permanently discontinue the Service or any feature thereof, in whole or in part, at any time. We will use commercially reasonable efforts to provide advance notice of material changes affecting paid subscribers, but no such notice is guaranteed.
7. Data & Privacy
Our handling of personal data is described in our Privacy Policy, which forms part of these Terms. The Service collects GPS, motion sensor, and trip data necessary to provide its features. You can request deletion of your data via the in-app account-deletion flow.
8. Intellectual Property
All rights in the Service — including software, branding, designs, and content created by us — remain the property of RideStats and its licensors. You retain ownership of trip data you generate using the Service; by using the Service you grant us a limited license to process that data for the purpose of providing the Service.
9. Disclaimers
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, accuracy of measurements, or uninterrupted availability. GPS, accelerometer, and scoring outputs are estimates and must not be relied upon for safety-critical or legal purposes (e.g., insurance disputes, court evidence).
10. Limitation of Liability
To the maximum extent permitted by law, RideStats and its officers, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or business opportunity, arising out of or in connection with your use of the Service. Our aggregate liability for any claim shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim or (b) ₹1,000 / US$15.
11. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or if continued provision of the Service to you would, in our reasonable judgment, expose us to legal or operational risk.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be announced via the App or by email and will take effect on the date specified. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of India. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, India, except where mandatory consumer protection law in your country requires otherwise.
